Capitis diminutio maxima

Capitis diminutio maximaWhat does Capitis Diminutio MAXIMA mean? Why is it so important to know about this? What is the purpose of it? And why is this so secretly hidden for such a long time? In this blog I will try and give you a few answers, or at least a few links to other sites that enable you to investigate for yourself.

The Law dictionary describes capitis diminutio (the general description) as follows:

In Roman law, A diminishing or abridgment of personality. Tills was a loss or curtailment of a man’s status or aggregate of legal attributes and qualifications, following upon certain changes in his civil condition. It was of three kinds, enumerated as follows: Capitis diminutio maxima. The highest or most comprehensive loss of status. This occurred when a man’s condition was changed from one of freedom to one of bondage, when he became a slave. It swept away with it all rights of citizenship and all family rights. Capitis diminutio media. A lesser or medium loss of status. This occurred where a man lost his rights of citizenship, but without losing his liberty. It carried away also the family rights. Capitis diminutio minima. The lowest or least comprehensive degree of loss of status. This occurred where a man’s family relations alone were changed. It happened upon the arrogation of a person who had been his own master, (sui juris,) or upon the emancipation of one who had been under the patria potestas. It left the rights of liberty and citizenship unaltered.”

Let us take a closer look on capitis diminutio maxima. It means that, whenever a baby is born, its birth has to be registered (reported) at City Hall, where it is registered in an official document called a birth certificate. This birth certificate is stated to be  a record of birth. Depending on the jurisdiction, it might or might not contain verification of the event by such as a midwife or doctor. In February 2005, Archbsihop Desmond Tutu states:

“…it’s a small paper but it actually establishes who you are and gives access to the rights and the privileges, and the obligations, of citizenship”

In fact, from that moment on, the citizen is then officially a slave of the system. While each birth certificate is written in capitis diminutio media, the document is used for trading from that moment on! Why and how, you may ask? Well, there is a profound reason for that.

About the why: Capitis diminutio is originated in the Roman era, with three changes of state or condition attended with different consequences. Ever since, it has been in use until the present day! For now, let us focus on the one with the most severe consequences. Capitis diminutio maxima involves the loss of liberty, citizenship, and family. This means that the person in question literally loses all rights as stated. In fact, it means that virtually all of us are no more than slaves! Mere objects that can be used at will by those in power! And here we arrive at the question why this has been so secretly hidden all this time. After all, if we knew that we are just slaves, then wouldn’t we revolt? We all think that we are free people, with rights and priviliges. Well, guess again! We really are slaves, being used by the “system” we so gladly support. How are we being used, you are asking? Think about it! When was the last time that you were free from paying taxes? Or when was the last time that you had gotten away with any crime you committed (speeding ticket, jaywalking, etc.), without suffering the legal consequences? And when was the last time that you could say or do what you wanted, without the risk of being judged in any way? Let’s face it, we all are slaves of the system! Slavery hasn’t gone, it is very much alive! Thanks to capitis diminutio…
